1. Introduction .
This document, together with all other documents mentioned above, establishes the terms and conditions governing the use of this website www.vistetelocal.com (the "Site") and current national legislation. We ask that you carefully read these terms and conditions, privacy policies, and return policies before using this website, as acceptance of these Terms and Conditions is an essential requirement for browsing and purchasing on the Site. By accepting these Terms and Conditions, users declare that they have been informed of them in a clear, understandable, and unequivocal manner, and that they have had the opportunity to save and print them. If you do not agree with all of the Terms and Conditions and the Privacy Policies, you should not use this website. 2. Vístete Local Representative. For all legal purposes and so that users of the Site can communicate with the company (" Vístete Local "), Ms. Camila Belén Fuentes Cid, domiciled for these purposes at 3037 Callao Street, Las Condes, Santiago, is designated as special representative. 3. Cookies on the Site. A "cookie" is a small file stored in a user's browser when accessing certain websites. Vístete Local uses "cookies" to improve understanding of the use of the Site and provide customers with information about their preferences and browsing patterns. A cookie collects information about browsing habits without accessing a user's personal data. This anonymous browsing data may be shared by Vístete Local with its business partners in order to provide better services. Cookies are "session" cookies when they are deleted once the user closes the web browser, and "persistent" cookies when they remain on the user's computer for a period of time defined by the cookie controller. Cookies may also be first-party cookies when managed on the same Site or third-party cookies when they are sent to the user's computer from a different website. The Site stores both its own and third-party cookies in order to adapt the content to your interests and facilitate access. Vístete Local uses third-party cookies to collect information and submit it for statistical processing; for this purpose, the services of Google Analytics (the "Server") are used. Once the user connects to the Site again, the Server will recognize the number stored in the "cookie", as indicated, providing anonymous information. The procedures are managed and controlled exclusively by Google Analytics. For online advertising, we use the Conversions API, which sends the purchase event between Shopify and Facebook's servers. Browser-based ad blockers cannot block the data sent from one server to the other. The Maximum setting shares your customer's personal information to match users on the Facebook network. Information collected through this setting includes your customer's name, location, email address, and phone number, as well as their browsing behavior on your online store. 4. User Registration. Users wishing to make purchases through the Site must register by providing personal information including their national identity card, address, and telephone number. Users guarantee the authenticity, accuracy, and validity of the data entered. Once registered, users must create a password, which will allow them to make purchases on the Site securely. The user is solely responsible for the correct use and confidentiality of this password. Users may change their password by following the instructions and procedures established on the Site. User registration on the Site implies acknowledgement and acceptance of the Terms and Conditions.
5. Use of Personal Data. The information provided by the user will be stored under high security standards, processed in accordance with the law, and for the exclusive purpose of completing transactions on the Site and improving the information and marketing of the products offered. Under no circumstances may it be communicated or transferred to third parties, except to individuals or companies related to Vístete Local. Vístete Local is a marketplace that works with partner stores (designers); therefore, when purchasing products sold directly by partner stores, personal data may be provided for the sole and exclusive purpose of shipping the products. Registered users may exercise their rights to information, modification, deletion, cancellation, and/or blocking of their personal data when they deem it appropriate, as established in Law No. 19,628 on the Protection of Privacy. Vístete Local provides users with an email address and the technological means on the Site so they can modify and/or correct their personal data.
6. Promotional or Advertising Communications. The user authorizes the sending of promotional or advertising communications by email. Notwithstanding the foregoing, the user may request the suspension of such communications at any time by clicking on the link provided.
7. Use of the Site. The Site provides the user with clear and precise instructions for making purchases through the Site. The mere fact that the user makes purchases following the instructions contained on the Site demonstrates that Vístete Local fully complies with the provisions set forth in this section. By using this website and placing orders through it, you agree to: Use this website only to make legally valid inquiries or orders. Not place any false or fraudulent orders. If it could reasonably be considered that such an order has been placed, we are authorized to cancel it and inform the relevant authorities. Provide us with your email address, postal address, and/or other contact information truthfully and accurately. You also agree that we may use this information to contact you if necessary (see our Privacy Policy). If you do not provide us with all the information we require, we will not be able to process your order. By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts.
8. Service Availability. The items offered through this website are only available for shipping within Chile. If you wish to place an order from another country through this website, you may of course do so; however, please note that we only offer express delivery within Santiago, Chile.
9. Product Availability. All orders are subject to product availability. If there are difficulties in supplying products or if items are out of stock, we will refund any amount you may have paid.
10. Payment Methods. Only the payment methods indicated on the Site may be used.
10.1. Visa, Mastercard, Magna, Diners Club International or American Express bank credit cards, issued in Chile or abroad.
10.2. Bank debit cards under the Redcompra system, issued by national financial institutions.
10.3. Non-bank credit cards: PayPal. Purchases made using any of the cards accepted on the Site will be subject to the provisions of the Terms and Conditions and the stipulations of the respective opening contracts signed by users with the respective financial institutions or companies, which prevail over this instrument. Thus, any type of liability that could be assigned to Vístete Local by virtue of said contracts is excluded. Payment by card will be made through MercadoPago, electronic payment systems that are responsible for automatically charging users' bank accounts quickly and securely. Users' personal information is stored on servers or magnetic media that maintain high security standards and, in particular, users' credit card data is stored in encrypted form. Vístete Local does not store the credit card data registered by users at the time of payment. Users may, without cause and at any time, use any payment method on the Site to make their purchases.
11. Formation of Consent. Acceptance of offers or purchases made on the Site will require prior confirmation and validation by Vístete Local for their completion. This, along with the general requirements established by law, will be an essential element for the formation of consent. In order to confirm the transaction, Vístete Local must verify: (a) That it has the products in stock at the time of acceptance of the offer. (b) That it validates and accepts the payment method offered by the user. (c) That the data registered by the user on the Site matches that provided upon purchase. Vístete Local will send written confirmation of its validation to the email address registered by the user on the Site, or by any other means of communication that guarantees the user's due and timely knowledge of said information, which will be indicated in advance on the Site. Consent will be deemed to have been formed once the written confirmation has been sent to the user and at the place where it was issued, that is, Callao Street 3037, Las Condes, Santiago. Visiting the Site does not impose any obligation on the user, unless he or she has unequivocally accepted the conditions offered.
12. Offer Conditions. The products, prices, and conditions offered will remain in effect as long as users can review them on the Site. Vístete Local may modify the information provided at any time and without prior notice until it receives acceptance of an offer from any user.
13. Coupons and Special Discounts. Coupons issued by both Vístete Local and third parties may be used. If a user uses coupons as a means of payment, they may be used only once and for the corresponding amount of the coupon. Discounts provided through coupons cannot be combined with other promotions. Some coupons may have limitations such as, but not limited to, the number of uses, minimum consumption, or expiration date. 14. Product Dispatch. Purchased products will be shipped to the user's address indicated when registering on the Site, in accordance with the conditions established in the Shipping Times and Costs section. Our products are sold and shipped directly by partner stores ("designers"). In this case, some products may be shipped separately according to the timeframes, costs, and conditions established at the time of purchase.
15. Exchanges and Returns. Instructions and specifications for product exchanges and returns are available in the Exchanges and Returns section. Products sold and shipped directly by partner stores through the Site will be subject to each store's return conditions and in accordance with current legislation.
16. Conditions of Sale for products through Partner Stores. Partner Stores (or Designer Stores) are an online product sales system through which Vístete Local makes its Site available as a sales and promotion channel for products from various offering companies (the "Stores"). The Site operates as a virtual showcase for the Stores to increase their online sales. Under the MarketPlace modality, the Stores are exclusively responsible for: (a) Managing the stock of available products. Therefore, the description of the product offered through the aforementioned modality includes the following note: "Sold and delivered by (Store name)". (b) The price at which the product is offered on the Site; and (c) Managing the order and delivering the purchased product to the Customer. Consequently, Vístete Local acts solely as an intermediary, and the aforementioned activities are outside its sphere of control. Ultimately, Vístete Local is solely responsible for: (a) Generating online traffic for the Stores' products on the Site; (b) Customer service for the Stores' products offered on the Site; and (c) Reverse logistics for the Stores' products offered on the Site. Once a purchase has been made through the Marketplace, Vístete Local will send written confirmation of its validation to the email address registered by the user on the Site, or by any other means of communication that guarantees the user's proper and timely knowledge of said information, which will be indicated in advance on the Site. The aforementioned confirmation, in the case of purchases made through the Marketplace, will contain, among other things, the following information in a clear and visible manner: "We have received your order and are processing it. If you purchased from an Associated Store, remember that the Associated Store must validate the product's data and stock availability." If the product is not in stock, Vístete Local will refund the full amount paid for the product within a maximum of 14 business days.
17. Site Security. Vístete Local maintains high security standards for product purchases through the use of SSL (Secure Sockets Layer) technology, which ensures both the authenticity of the Site and the encryption of all information provided by users. In the event that difficulties arise that prevent or delay the purchase of products, Vístete Local will adopt the necessary measures, in accordance with the available technological means, to normalize the continuity and normal operation of the Site.
18. Validity of the Terms and Conditions. We reserve the right to modify the Terms and Conditions. These will not be retroactive. If you do not agree with the modifications, we recommend that you do not use our website. The use of our website and the purchase contracts for products through the Site will be governed by Chilean law. Any dispute arising from or related to the use of the website or such contracts will be subject to the non-exclusive jurisdiction of the Chilean courts. If you are contracting as a consumer, nothing in this clause will affect your rights under current law. 20. Legal Entity. The legal entitlement of Ms. Camila Belén Fuentes Cid to act on behalf of NashionIt SpA is established by a public deed dated June 29, 2016.
